legal and ethical issues
Copyright
Copyright is the legal right of the owner of intellectual property. This law was put in place to prevent people from stealing the work of other people without permission for their own use. This is a right that is automatically put in place as soon as the work has been produced, making sure that anyone who may want to use the work will need the owners permission beforehand. If they break the copyright law then they get the punishment of their own form of work being removed or they will not be able to make a profit from it. In my case, if my product is recreated by a company without my permission then I will have the right to take legal action. Within my campaign I also need to make sure that all images need to be taken by me so that I avoid any potential risks of copyright. However, If I was to break copyright laws accidentally then this could result in potential punishments such as the advertisements being removed from all media platforms or maybe even a potential financial fine towards me.
Permission (model and location)
Permission is where a film company decides to film in an area which is already owned by a company or government and they need to ask the owner of the area if they can film there. If the film company does not get permission to film in that area but does it regardless then the owner of the are has the right to take legal action towards the director of the film. In my case I will prevent this by filming in public location which does not require permission or on my own property. However, If I was to film in the location of the owner without permission then they would most likely ban or remove me from the area or take legal action against me for filming without their permission.
Royalties
Royalties are a payment between one company to another to gain the right to use the companies assets such as copyrighted works, franchises and natural resources. This can be a one time payment to be able to permanently use the assets or an on going payment over the period of time in which the asset is used. In my case I will not need to pay royalties to a different company for my advertisement as I am not planning on using a different companies assets. However, If I was to use another companies assets without paying royalties then they would most likely take legal action against me such as a fine.
Offensive language/behaviour
Offensive language/behaviour is the act of causing a group or individual to feel emotionally hurt or insulted. This can sometimes happen in advertisements that mention certain groups in a bad light, the consequence of this is public outrage resulting in the advertisement being removed from television or potentially even a lawsuit. I will prevent this from happening in my advertisement by not mentioning any about ethnicity, age, religion, gender or political stand point to make sure that my advertisement does not offend anyone. However, if I was to include offensive content within my advertisement then this would cause potential backlash from the public which would most likely cause social media platforms to remove my content.
Violence
Violence is the act of committing physical harm to an individual or group. This isn't allowed to be shown or incited in advertisements as people have different sensitivities to graphic or violent content, the consequence to showing this on an advertisement is the chance of it being removed from television. I will prevent this from happening in my advertisement by not including anything that could be perceived as violent or graphic. However, if I was to include violence within my animations then this may upset the audience causing backlash.
Representation
Representation is how certain companies portray themselves using an advertisement. This is an important factor for all companies as they want their reputation to be the best it possibly can be amongst consumers. As advertisements are the forefront of a company, they let the consumer decide if they want to invest into that product/service. I will achieve a good reputation through my advertisement by making my company seem friendly and respectable, this will be done by not offending other groups in the advertisement and only promoting the product.
